Most of our products and services (including technical data and software) are strictly export controlled by the Arms Export Control Act, the International Traffic in Arms Regulations (“ITAR”), and by additional statutory/regulatory authority as well. If a particular product or service is captured by the ITAR’s “defense article” or “defense service” definitions, an export license issued by the United States Department of State, Directorate of Defense Trade Controls (“DDTC”) may be required before that product or service can be lawfully exported. Please note that ITAR violations may result in severe criminal and civil penalties. Such penalties include fines of up to $1,000,000 per violation and up to 20 years imprisonment. Additionally, other potential sanctions include debarment, denial of export privileges and publication of a press release by DDTC regarding the violator and the violation. Please note that the United States very actively pursues and prosecutes export control violation cases.
